New DME Rules Now in Effect for APRNs

Thanks to a petition initiated by TNP, the Texas Health and Human Services Commission has adopted rules to allow nurse practitioners to order durable medical equipment and supplies for Medicaid/CHIP patients (Title XIX form). See final rules here and a brief summary below.
Please note: While these changes are in effect, Title XIX forms have not been updated on the Texas Medicaid & Healthcare Partnership (TMHP) website. However, TMHP staff will process these forms and requests if the signature and NPI are from a nurse practitioner or clinical nurse specialist. The updated policies will be published in the Texas Medicaid Provider Procedures Manual on February 1, 2023.
1 TAC Chapter 354, Subchapter A, Purchased Health Services (ADOPTED)
These rules, effective September 21, 2022, allow nurse practitioners, clinical nurse specialists, and physician assistants to prescribe home health services, including durable medical equipment, within the Texas Medicaid system. These rules align Texas Medicaid policy with federal Medicare changes that resulted from the CARES Act.
